Overview of Law
Employers in New York may not discharge or discriminate against an employee for doing any of the following:
- Reporting or threatening to report a violation of the law that creates a danger to public health or safety if the employee gave the employer a chance to fix the violation
- Participating in an investigation regarding a violation of the law
- Refusing to participate in a violation of the law
- Exercising their rights under the Labor Law
In addition, employers of healthcare workers may not discharge or discriminate against them for reporting or opposing what they reasonably believe to be a violation of the standard of care.
