NYS Noncompetition Agreements

Overview of Law
New York disfavors non-competition agreements and will only uphold them if they are reasonable. To determine reasonableness, a court will consider the following factors:
- Duration
- Geographic area
- Whether the restrictions are necessary to protect the employer’s legitimate business interests
- The burden on the employee
- Any harm to the public interest
Protectable interests include trade secrets and confidential customer information.
New York prohibits noncompetition agreements in the broadcasting industry.
