Effective June 8, 2025, the daily rate for jury service is increasing, and it's crucial for employers of all sizes to be aware of these updates to ensure compliance and avoid potential issues.

Understand the New Daily Rate

Previously, New York jurors received $40 per day for their service. However, effective Sunday, June 8, 2025, this daily rate will increase to $72. This change reflects a broader effort to provide a more equitable allowance for citizens fulfilling their civic duty.

Who Pays What? It Depends on Your Business Size

The responsibility for this increased payment isn't universal across all New York employers. The existing framework for who pays remains in place, but with the new dollar amount:

  • Employers with 11 or More Employees: If your business employs 11 or more individuals, you are responsible for paying your employees the new daily rate of $72 for each of their first three days of jury service. After the third day, the state will cover the daily rate.
  • Employers with 10 or Fewer Employees: For smaller businesses, the time off is protected, but unpaid for your jury service. 

It's important to note that these guidelines apply to non-exempt employees. For exempt employees, generally, their full salary must be paid for any workweek during which they perform any work, even if a portion of that week is spent on jury duty. However, employers can offset any amount the employee receives from the state. If an exempt employee is out for an entire workweek and performs no work at all, then pay is not required for that specific week.

What This Means for Your Business

Staying on top of labor law changes is vital for smooth operations. Here are your key action items:

  1. Update Your Payroll Provider: If you're a Complete Payroll client, you have nothing to worry about. We will ensure your people are paid the updated rate. If not, ensure that your payroll provider is fully aware of the new $72 daily rate and the effective date of June 8, 2025. This will prevent incorrect payments and potential discrepancies.
  2. Review and Revise Your Employee Handbook: If your employee handbook or company policy explicitly details jury service pay, it's time to update it to reflect the new $72 rate. Clear and accurate policies help both employers and employees understand their rights and obligations.
  3. Communicate with Employees: Consider proactively informing your employees about this change, especially if you have a larger workforce. Transparency fosters trust and helps employees understand how their jury service will be compensated.

Navigating labor laws can feel complex, but staying informed and prepared is key. This adjustment to jury duty pay is a reminder that the regulatory landscape is always evolving. By taking these proactive steps, New York businesses can ensure they remain compliant and continue to support their employees in fulfilling their civic responsibilities.
